1. About These Terms
These Website Terms of Use ("Terms") govern your access to and use of the WorldStrides Australia website at worldstrides.com.au, together with any associated mobile-optimised versions and WorldStrides apps (collectively, the "Platforms"). The Platforms are owned and operated by WorldStrides Pty Ltd (ABN 85166506172) trading as WorldStrides Australia ("WorldStrides", "we", "us" or "our").
These Terms govern your use of the Platforms only. They do not govern the terms on which you register for, or purchase, a WorldStrides travel program, tour or other educational travel service. Those are set out separately in the Terms and Conditions presented to you at the time of enquiry, registration or payment through our registration system, and, where applicable, in a separate agreement between WorldStrides and your school or institution. If these Terms conflict with the Program and Booking Terms and Conditions in relation to a specific program or booking, the Program and Booking Terms and Conditions prevail.
2. Acceptance of These Terms
By accessing or using the Platforms, you agree to be bound by these Terms and by our Privacy Policy and Cookie Notice, which are incorporated into these Terms by reference. If you do not agree, please do not use the Platforms.
We may update these Terms from time to time (see clause 15). Your continued use of the Platforms after an update constitutes acceptance of the updated Terms.
3. Use of the Platforms
The Platforms are provided to help visitors learn about WorldStrides and its educational travel programs, browse program and destination information, access resources for teachers, parents and students, register interest in a program, and manage an existing account or booking.
Subject to your compliance with these Terms, WorldStrides grants you a non-exclusive, non-transferable, revocable, limited licence to access and use the Platforms and to print or download individual pages for your own personal, non-commercial use. This licence does not permit you to:
(a) copy, reproduce, republish, modify, distribute, transmit, display, perform, or create derivative works from any content, trademark, design, image, video or other material on the Platforms, except as expressly permitted;
(b) use any part of the Platforms, or an account on the Platforms, for a commercial purpose without our prior written consent;
(c) use a robot, spider, scraper or other automated means to access or copy content from the Platforms without our express written consent;
(d) remove or alter any copyright, trademark or other proprietary notice on the Platforms;
(e) reverse engineer, decompile or disassemble any software underlying the Platforms; or
(f) do anything that places an unreasonable or disproportionate load on the infrastructure of the Platforms.
We may suspend or terminate your access to the Platforms where we reasonably believe you have breached these Terms.
4. Eligibility and Use by Minors
The Platforms are intended for use by parents, guardians, teachers, school staff and other adults enquiring about or managing WorldStrides programs, as well as by students old enough to responsibly use the internet. To create an account, submit a form that collects personal information, or make an enquiry on behalf of yourself or another person, you must be at least 18 years old, or use the Platforms under the supervision of, and with the consent of, a parent, guardian or teacher who agrees to be responsible for that use.
If you are a parent, guardian, teacher or school representative using the Platforms on behalf of a student or minor, you are responsible for the accuracy of any information you provide about that person and for having the authority to provide it.
5. User Accounts
If the Platforms allow you to create an account, you are responsible for keeping your login details confidential and for all activity under your account. Notify us promptly of any unauthorised use. You agree to keep your account information current and accurate.
We may deny or suspend access to the Platforms, at our reasonable discretion, where we believe an account is being used fraudulently, in breach of these Terms, or in a way that could harm WorldStrides, other users, or the security of the Platforms.
6. User Content
If you post, upload or submit photos, comments, reviews, testimonials or other material to the Platforms or our social media channels ("User Content"), you retain ownership of it, but you grant WorldStrides a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish and display that User Content in connection with the Platforms and our marketing activities (including social media and email), for as long as reasonably necessary for those purposes. To the extent permitted by law, you consent to any act or omission by WorldStrides in connection with this licence that might otherwise infringe your moral rights in the User Content.
You warrant that you own, or have the necessary rights to, any User Content you submit, that it does not infringe any third party's rights, and that it is not unlawful, defamatory, discriminatory or offensive. We may remove or decline to publish User Content at our discretion.
7. Intellectual Property
All content on the Platforms — including text, graphics, logos, images, video, software and their arrangement — is owned by or licensed to WorldStrides and protected under the Copyright Act 1968 (Cth) and other applicable intellectual property laws. Except as permitted under clause 3 or under an applicable exception in Australian law, you must not use this content without our prior written permission.
8. Copyright Complaints
If you believe material on the Platforms infringes your copyright, contact us at legal@worldstrides.com with:
- a description of the copyrighted work you believe has been infringed;
- the location (URL) of the material you believe is infringing;
- your name and contact details; and
- a statement that you believe, in good faith, that the use is not authorised by the copyright owner, its agent, or the law.
We will investigate good-faith reports and take appropriate action, which may include removing or disabling access to the relevant material.
9. Third-Party Links and Services
The Platforms may link to websites, tools or services operated by third parties (for example, payment providers, insurers, or destination information sites). These links are provided for convenience only. We do not control, and are not responsible for, the content, privacy practices, or terms of any third-party site, and a link does not imply our endorsement of it.
The Platforms use Google reCAPTCHA to help protect against spam and abuse. This site is protected by reCAPTCHA and the Google Privacy Policy and Terms of Service apply.
10. Privacy and Cookies
Our collection and handling of personal information through the Platforms is described in our Privacy Policy and Cookie Notice. By using the Platforms, you acknowledge your personal information will be handled in accordance with those documents.
11. Disclaimers
The Platforms and their content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, and subject to clause 12, WorldStrides makes no warranty, express or implied, regarding the accuracy, completeness, reliability, or availability of the Platforms or their content, and does not warrant the Platforms will be uninterrupted, secure or error-free.
Because we cannot guarantee the security of information transmitted over the internet, we are not responsible for the security of information you send to us, or that we send to you, over the internet or other public networks.
12. Non-Exclusion of Consumer Guarantees
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted or modified. Where our liability for failing to comply with a consumer guarantee may be limited, and it is fair and reasonable to do so, our liability is limited, at our option, to resupplying the relevant services or paying the cost of having them supplied again.
13. Limitation of Liability
Subject to clause 12, and to the maximum extent permitted by law, WorldStrides, its officers, employees and agents are not liable to you for any indirect, special, incidental or consequential loss or damage (including loss of profits, data, or business opportunity) arising from or connected with your use of, or inability to use, the Platforms, even if we have been advised of the possibility of such loss.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited.
14. Indemnity
To the extent permitted by law, you agree to indemnify WorldStrides against any claim, loss, damage or expense (including reasonable legal costs) arising from your breach of these Terms, your violation of any law, or your misuse of the Platforms, except to the extent caused by our negligence or wilful misconduct.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, our services, or the law. We will post the updated Terms on this page with a new "last updated" date, and where practicable, highlight significant changes on the Platforms.
16. Suspension and Termination
We may suspend or terminate your access to all or part of the Platforms at any time, with or without notice, including where we reasonably believe you have breached these Terms or applicable law.
17. General
Severability. If a provision of these Terms is found invalid or unenforceable, it will be read down to the minimum extent necessary, and the remaining provisions continue in full force.
Waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
Entire agreement. These Terms, together with our Privacy Policy, Cookie Notice, and any Program Terms and Conditions applicable to a specific program, constitute the entire agreement between you and WorldStrides regarding your use of the Platforms.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of Victoria, Australia. You and WorldStrides submit to the non-exclusive jurisdiction of the courts of Victoria and any courts competent to hear appeals from those courts.
